Since 1940, active duty and deployed military have been protected by legislation like The Servicemembers Civil Relief Act (SCRA).

The SCRA is intended to postpone, suspend, or alleviate certain civil and financial obligations so servicemembers can devote their full attention to their duties. It also helps reduce the amount of stress felt by both those in service and their family members.

The SCRA will:

  • Limit the amount of interest that may be collected on debts, incurred prior to entering military service, to a maximum of 6 percent per year, during your service period.
  • Forgive permanently any amount of interest over and above that 6 percent during active duty for most loans and for an additional year after termination of active duty for mortgage loans.
  • Stop excess interest from accruing on credit obligations while you are on active duty. The monthly payment must be reduced by the amount of interest saved during the covered period.

All active duty members of the military including those listed below.

  • Army, Navy, Air Force, Marine Corps and Coast Guard, including reservists serving on active duty.
  • Members of the National Guard who have been called to Federal Duty by the President of the United States or Secretary of Defense for a period of more than 30 consecutive days for purposes of responding to a national emergency declared by the President and supported by Federal funds.
  • Public Health Service and National Oceanic & Atmospheric Administration members who are on active service.

Most protections begin the date a servicemember enters active duty. The termination dates applicable to protections and benefits can vary.

SunTrust applies the 6% maximum interest rate to all obligations for servicemembers incurred prior to entering active duty where you are individually liable on the debt, whether or not others are also liable. You must notify SunTrust of your military service within 180 days of termination of service to obtain the benefit of the 6% interest rate maximum.
